What What (In the Butt) is a web-bred music video produced by Brownmark Films around a song by Samwell. Most everyone can agree on that part of the story.
Two years ago, a South Park episode (Canada on Strike) featured a music video that Brownmark alleges is too much like their What-Butt viralnet musie.
After chewing on the ordeal for a while they filed a copyright lawsuit Friday against the animated sitcom producers (and that includes Viacom and Comedy Central), according to The Hollywood Reporter.
“…willful, intentional, and purposeful, in disregard of and indifferent to the rights of Brownmark,” the suit filed in Wisconsin says about the intentions of the mighty South Park producers, among other things. And among those things include a permanent injunction (episode forever crated) and statutory damages (money from deep pockets).
The journey of this case and its outcome will be instructive in clarifying (maybe) where infringement, satire and fair use stand.
